Most employers are required to display certain informational posters within the workplace in order to comply with state and federal laws. These posters cover topics that include the federal minimum wage, anti-discrimination laws, equal employment opportunity, the Polygraph Protection Act, and worker safety laws.  Listed below are employer posters that should be displayed to insure compliance with current state and federal requirements.   These posters are available FREE by calling the regulatory agency listed.  A link is provided for those posters that can be downloaded from the Internet.  

State Posting Requirements:  

Department of Labor and Economic Growth (DLEG)
On December 8, 2003, Governor Granholm's Executive Order 2003-18 renamed the Department of Consumer and Industry Services (CIS) the Department of Labor & Economic Growth (DLEG). 

Former CIS programs that now fall under DLEG include the Liquor Control Commission and the Bureau of Safety & Regulation (which has been renamed MIOSHA, the Michigan Occupational Safety & Health Administration).  The Bureau of Worker’s & Unemployment Compensation has been divided into three agencies within the DLEG: Unemployment Insurance Agency; Workers’ Compensation Agency; and the Wage and Hour Division.

MIOSHA - Summary of Occupational Injuries and Illnesses
MIOSHA requires employers with 11 or more employees to log and maintain records of work-related injuries and illnesses, and to make those records available during MIOSHA inspections of the workplace.  Employers are required to post the total number of job-related injuries and illnesses that occurred during the previous calendar year.

Michigan Employment Security Act - Notice to all Employees  
Note:  The Notice to all Employees sign has recently been updated to include information about two of the new ways to file for unemployment benefits - telephone and Internet.

In the Winter 2004 Unemployment Insurance Agency newsletter (received by MGA on April 23, 2004) it states that one copy of the poster is being sent to each employer in the Unemployment Insurance Agency's database.  The above link is for the new revised form.  Signs are also available by calling the Unemployment Insurance Agency hotline at 800.638.3994 weekdays from 8 am to 5 pm.

Michigan Minimum Wage Law & Youth Employment Standards Act posters are also available by contacting the Wage & Hour Division at 517.322.1825.

* NOTE:  Employees that produce goods for sale outside Michigan (for interstate commerce) and all employees of business with annual revenue over $500,000 are covered by the Fair Labor Standards Act of 1938 (FLSA).  Because Michigan's minimum wage is HIGHER than the federal minimum wage, the state minimum wage applies.  However, all employers, regardless of size, are required by law to have both the state and federal postings, including the new federal minimum wage poster, hung in a conspicuous place.

The following Michigan Minimum Wage Law posters are required by law to be posted in the work place if you are not covered by the Federal Fair Labor Standards Act of 1938, as amended (FLSA) or federal minimum wage provisions would result in a lower minimum wage than provided in the Michigan Minimum Wage Law.

Federal Minimum Wage Poster  New Poster Now Available!
(Note:  President Bush signed into law on May 25, 2007, House Resolution 2006, which includes the "Fair Minimum Wage Act of 2007."  The Act provides for a three-step increase in the federal minimum wage.  The minimum wage will be changing to $5.85 per hour effective July 24, 2007.  The wage will then change to $6.55 per hour beginning July 24, 2008 and to $7.25 per hour beginning July 24, 2009.   This also means that the federal minimum wage poster will be changed.  All Employers, regardless of size, are required by law to have both the state and federal postings, including the new federal minimum wage poster, hung in a conspicuous place.

On January 28, 2008 President Bush signed into law the National Defense Authorization Act for FY 2008 (NDAA), Public Law 110-181. Section 585(a) of the NDAA amended the FMLA to provide eligible employees working for covered employers two important new leave rights related to military service. If you are covered by the provisions of the Act you must also post the FMLA Poster Insert for Military Family Leave Amendments (PDF).

  * Notice to Workers with Disabilities  (Required if you employ workers with disabilities under special minimum wage certificates authorized by the Fair Labor Standards Act, the McNamara-O'Hara Service Contract Act, and/or the Walsh-Healey Public Contracts Act)

Uniformed Services Employment and Reemployment Act 
On Dec. 10, 2004, President Bush signed the Veteran Benefit Improvement Act (VBIA) of 2004 that amends the employment rights mandated by the Uniformed Services Employment and Reemployment Act of 1994 (USERRA).  The new act extends coverage to up to 24 months (formerly 18) for employees called to active duty.

One of the requirements of the law is that effective March 10, 2005, all employers, regardless of size, must provide employees with notice of their rights, benefits and obligations under USERRA.

 
bullet Earned Income Credit/IRS Notice 797 Scam
There is no such notice requirement. The Earned Income Credit does not apply to all employees. The IRS Notice 797 is "Possible Federal Tax Refund Due to the Earned Income Credit." You cannot meet the requirement by posting the information. If you have employees who are eligible for the Earned Income Credit, you must provide the information to them directly by handing them the IRS Notice 797 or by sending it by first class mail. Food Industry Specific Posting Requirements:

In addition to posting various licenses (liquor, sales tax, food establishment) the following postings are required (when applicable) under various Michigan laws regulating the food industry.  The number listed is the section of Michigan Compiled Law that addresses the requirement.  Links are provided to download a complete copy of the law.  

Item Pricing Act:  Signs for classes of items not individually price marked MCL 445.353 of Michigan Pricing and Advertising of Consumer Items - Act 449 of 1976

Bottle Deposit Law:  Penalties for return of out-of-state nonreturnable containers  MCL 445.574b of Beverage Containers - Initiated Law of 1976

Michigan Liquor Control Code:  Selling or furnishing alcoholic liquor to a minor MCL 436.1701 of Michigan Liquor Control Code - Act 58 of 1998
  2007 Signs are available from the Michigan Liquor Control Commissions website or by calling 517.322.1345.

Meth Law:  Signs required MCL 333.177766(f) of Public Health Code - Act 368 of 1978
  Public Acts 86 of 2005 restricting the sale of products containing ephedrine or pseudoephedrine takes effect on December 15.  Retailers must post, in a place close to the point of sale and conspicuous to employees and customers a sign produced by the Department of Community Health.  
 
Full-page sign, 36-point type:  If the sign is more than six feet from the point of sale, the sign has to be 5 by 1/2 inches by 8 1/12 inches and the required statement has to be printed in 36- point boldfaced type.  
 
Half-page sign, 20 point type:  If the sign is six feet or less from the point of sale, it has to be 2 inches by 4 inches and the statement has to be printed in 20-point boldfaced type.
 
The federal Combat Methamphetamine Epidemic Elimination Act (CMEEA), places significant restrictions on retail sales of over-the-counter pseudoephedrine (PSE) products.  The federal law does not mirror Michigan's "Meth Law".  It is important to remember that whichever law is the strictest is the law the prevails. Youth Tobacco Act:  Sign required; copies
MCL 722.641 of Youth Tobacco Act - Act 31 of 1915
  Warning signs with the required statement, "The purchase of tobacco products by a minor under 18 years of age and the provision of tobacco products to a minor are prohibited by law.  A minor unlawfully purchasing or using tobacco products is subject to criminal penalties.", are available from the Michigan Department of Community Health by calling 800.537.4666 or by faxing your order to 517.882.7778.  Be sure to indicate size and quantity of stickers required. The 20-point type sign can also be downloaded by clicking the link below.
 
Note: 
If the sign will be more than 6 feet from the point of sale, it must be 5 1/2 inches by 8 1/2 inches and the required statement must be printed in 36-point boldface type.  If the sign is 6 feet or less from the point of sale, the sign must be 2 inches by 4 inches and the required statement must be printed in 20-point type.

  MDCH has a free Tobacco Retailer Kit that contains helpful information on preventing tobacco sales to minors.  The Coalition for Responsible Tobacco Retailing's We Card program also provides a number of reasonably priced training, POS and reference materials.  Retailers can order the materials by calling 800.934.3968 or online at www.wecard.org.

Fish and Produce Nutrition Labeling Information
  [February, 2008]  Retailers are urged to post new nutrition information for Fish and Produce immediately in their produce and seafood departments as part of the current FDA nutrition labeling program for fresh foods.  Failure to do so could prompt FDA to turn this voluntary program into a regulatory mandate.  Click here to download the information you need.
